Today, U.S. Congressman Paul A. Gosar, D.D.S. (AZ-04) released the following statement after the Fifth Circuit Court of Appeals upheld the February ruling by U.S. District Judge Andrew Hanen who issued an injunction to stop President Obama’s unconstitutional November 2014 executive immigration orders from going into effect:
“Today’s court decision is a huge win for the rule of law and our Constitution. Article I gives Congress clear jurisdiction on immigration matters and the Obama Administration’s rogue executive actions have clearly infringed on that authority.
“The list of federal judges who have ruled Obama violated the law is growing, and the opinion of the Fifth Circuit confirms the president’s overreach. Needless to say, I am thrilled by the court's decision and will continue to do my part to rein in this unaccountable, out-of-control federal government that has chosen not to enforce our immigration laws.”

Judge Hanen’s ruling stemmed from a lawsuit led by Texas Governor Greg Abbott and 25 other states, including Arizona, that argued President Obama unconstitutionally bypassed Congress when he took executive action last November to expand Deferred Action for Childhood Arrivals (DACA) and Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA).
On May 11, 2015, Rep. Gosar and more than 100 members of Congress filed a bicameral amicus brief in support of the continued injunction. The amicus brief can be found HERE.
Congressman Gosar has lead several efforts to fight the President’s amnesty orders including organizing an effort call on the Government Accountability Office to investigate whether the president’s latest actions violated the Anti-Deficiency act. Click HERE to read more about that effort.
In March, Congressman Gosar lead a legislative effort supported by 14 House colleagues to the House Appropriations Subcommittee on Homeland Security asking for a funding rider in the fiscal year 2016 appropriations act that would prohibit funds or collected fees from being used to implement President Obama’s numerous executive amnesty orders.
