&lt;h2&gt;&lt;i&gt;The visa program that allowed foreign workers to fill jobs when no qualified American worker was available must be reformed. The End H1-B Visa Abuse Act will help protect those American workers.&lt;/i&gt;&lt;/h2&gt;

&lt;p&gt;For decades, Washington elites and multinational corporations have sold the American people a&amp;nbsp;&lt;a href="https://cis.org/Report/Untold-Stories-American-Workers-Replaced-H1B-Visa-Program" target="_blank" title="https://cis.org/Report/Untold-Stories-American-Workers-Replaced-H1B-Visa-Program" data-outlook-id="f26649b7-2104-40e0-8182-d0af3431b563"&gt;lie about the H-1B visa program&lt;/a&gt;. Americans were told the program existed to fill temporary labor shortages with highly specialized workers when no qualified American could be found. That may have been the original promise, but today the H-1B system has become something entirely different: a pipeline for replacing American workers with cheaper foreign labor while corporate executives reap larger profits.&lt;/p&gt;
&lt;p&gt;That is why I proudly joined Congressman Eli Crane, R-Arizona, and several of my colleagues in introducing&amp;nbsp;&lt;a href="https://www.congress.gov/bill/119th-congress/house-bill/8443" target="_blank" title="https://www.congress.gov/bill/119th-congress/house-bill/8443" data-outlook-id="dfc0a041-9df8-4643-9a41-020e876484bb"&gt;H.R. 8443, the End H-1B Visa Abuse Act of 2026.&lt;/a&gt;&lt;/p&gt;
&lt;p&gt;This legislation is built on a simple principle: American jobs should go to American workers first.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;How does the H-1B visa system work?&lt;/b&gt;&lt;/p&gt;
&lt;p&gt;The current H-1B system is badly broken. Large corporations have learned how to manipulate loopholes to import lower-cost labor instead of investing in our own citizens. Too many Americans have experienced the humiliation of being forced to&amp;nbsp;&lt;a href="https://www.nytimes.com/2015/06/04/us/last-task-after-layoff-at-disney-train-foreign-replacements.html" target="_blank" title="https://www.nytimes.com/2015/06/04/us/last-task-after-layoff-at-disney-train-foreign-replacements.html" data-outlook-id="8d25ee49-f4bf-45ef-a27c-5b64639b6d35"&gt;train their foreign replacements&lt;/a&gt;&amp;nbsp;before being shown the door. Wages are suppressed, opportunities shrink and young graduates are told there are “worker shortages” while qualified Americans struggle to find jobs in their own country.&lt;/p&gt;
&lt;p&gt;Enough is enough.&lt;/p&gt;
&lt;p&gt;The End H-1B Visa Abuse Act imposes a three-year pause on new H-1B visas while reforming the system to put American workers first. The bill reduces the visa cap, eliminates loopholes, replaces the random lottery with a wage-based process, raises salary requirements to $200,000, bans staffing agency abuse and requires employers to prove they cannot find qualified American workers before hiring from overseas.&lt;/p&gt;
&lt;p&gt;Most importantly, the legislation restores the program’s original purpose instead of allowing it to operate as a corporate outsourcing pipeline inside the United States.&lt;/p&gt;
&lt;h2&gt;How do foreign students get to stay in the US after graduation?&lt;/h2&gt;
&lt;p&gt;One of the most important provisions in this legislation is ending the&amp;nbsp;&lt;a href="https://www.uscis.gov/working-in-the-united-states/students-and-exchange-visitors/optional-practical-training-opt-for-f-1-students" target="_blank" title="https://www.uscis.gov/working-in-the-united-states/students-and-exchange-visitors/optional-practical-training-opt-for-f-1-students" data-outlook-id="46169719-71df-44fa-a543-fa66a60b1f9d"&gt;Optional Practical Training&lt;/a&gt;&amp;nbsp;program, better known as OPT — a&amp;nbsp;&lt;a href="https://gosar.house.gov/news/documentsingle.aspx?DocumentID=9130" target="_blank" title="https://gosar.house.gov/news/documentsingle.aspx?DocumentID=9130" data-outlook-id="9f3a61d2-0275-4060-8d96-954cca0fdddb"&gt;deeply flawed scheme I have fought against for years&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;The OPT program was never authorized by Congress, yet unelected bureaucrats expanded it anyway. Under OPT,&amp;nbsp;&lt;a href="https://www.congress.gov/crs-product/IF12631" target="_blank" title="https://www.congress.gov/crs-product/IF12631" data-outlook-id="e90439fb-9fee-4509-b730-d4f651226389"&gt;foreign students can remain in the United States&lt;/a&gt;&amp;nbsp;and work for years after graduation, effectively bypassing the legal limits Congress established for H-1B visas. What was originally presented as temporary practical training has evolved into a shadow guest-worker pipeline benefiting multinational corporations at the expense of American graduates.&lt;/p&gt;
&lt;p&gt;Even worse, the federal government actively incentivizes employers to hire OPT workers over Americans. Companies employing OPT participants are exempt from&amp;nbsp;&lt;a href="https://www.congress.gov/crs-product/IF12631" target="_blank" title="https://www.congress.gov/crs-product/IF12631" data-outlook-id="bc0234ee-dd4b-4a5a-8dd7-12126cda45f9"&gt;paying certain payroll taxes&lt;/a&gt;, including Social Security and Medicare contributions, for several years. That means foreign labor under OPT can cost employers significantly less than hiring an American worker with identical qualifications.&lt;/p&gt;
&lt;p&gt;Think about how outrageous that is.&lt;/p&gt;
&lt;h2&gt;How will the End H-1B Visa Abuse Act help Americans?&lt;/h2&gt;
&lt;p&gt;Young Americans spend years studying engineering, science, technology, mathematics and medicine. They take on enormous student debt, work hard and do everything society tells them to do to succeed. Yet many discover the system has been rigged against them from the start because corporations can save money by hiring foreign workers through visa loopholes.&lt;/p&gt;
&lt;p&gt;That is not fairness. That is economic sabotage.&lt;/p&gt;
&lt;p&gt;For years, I have&amp;nbsp;&lt;a href="https://gosar.house.gov/news/email/show.aspx?ID=UBCCICR7UKJOZ4WY6L6AMMS3II" target="_blank" title="https://gosar.house.gov/news/email/show.aspx?ID=UBCCICR7UKJOZ4WY6L6AMMS3II" data-outlook-id="af71e7d3-e3b4-4ace-909a-8fac488c8748"&gt;led the fight to eliminate&lt;/a&gt;&amp;nbsp;this unlawful and anti-worker program because our government should never reward companies for replacing American citizens with cheaper foreign labor. I&amp;nbsp;&lt;a href="https://www.congress.gov/bill/116th-congress/house-bill/3564" target="_blank" title="https://www.congress.gov/bill/116th-congress/house-bill/3564" data-outlook-id="d9b65415-a94e-44e5-ba4f-097547affa88"&gt;first introduced legislation&lt;/a&gt;&amp;nbsp;to end OPT during the 116th Congress and have consistently supported efforts to challenge the program.&lt;/p&gt;
&lt;p&gt;Predictably, the political left and their allies in corporate America are already attacking this legislation. They claim industries like health care, engineering and technology would collapse without endless access to imported labor. That argument is dishonest and insulting to the hardworking Americans already serving in those professions and to the next generation preparing to enter them.&lt;/p&gt;
&lt;p&gt;There is&amp;nbsp;&lt;a href="https://cis.org/Report/There-STEM-Worker-Shortage" target="_blank" title="https://cis.org/Report/There-STEM-Worker-Shortage" data-outlook-id="c27d2c41-53cb-4e42-b3a9-fda735c3a302"&gt;no shortage of talent in Arizona&lt;/a&gt;&amp;nbsp;or across America. We have talented students, nurses, technicians, engineers and medical professionals who simply want a fair opportunity to compete. The real problem is that too many corporations have become addicted to cheaper labor instead of investing in recruitment, training, retention and competitive wages for American workers.&lt;/p&gt;
&lt;p&gt;If an employer truly cannot find qualified Americans after offering fair pay, that is one thing. But too often, corporations use H-1B visas and OPT to avoid recruiting, training, and fairly compensating American workers.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;America should prioritize Americans&lt;/b&gt;&lt;/p&gt;
&lt;p&gt;For years, politicians in both parties told Americans they must accept stagnant wages and shrinking opportunities because “global competition” demanded it, while the elites promoting those policies avoided the consequences as working families paid the price.&lt;/p&gt;
&lt;p&gt;The America First movement rejects that failed ideology.&lt;/p&gt;
&lt;p&gt;Every country prioritizes its own citizens. America should do the same.&lt;/p&gt;
&lt;p&gt;Congress now faces a clear choice: continue allowing corporations to manipulate the system while American families fall behind or rebuild an economy that rewards Americans instead of replacing them.&lt;/p&gt;

&lt;p&gt;This is not a partisan issue. &amp;nbsp;This is about military readiness, national security, and protecting the safety of the troops training at Yuma Proving Ground.&amp;nbsp; Our military must have the tools, land, and operational flexibility necessary to prepare for modern threats and evolving battlefield conditions.&lt;/p&gt;
&lt;p&gt;The Yuma Proving Ground is a cornerstone of Arizona’s economy and our nation’s defense infrastructure.&amp;nbsp; This legislation strikes the right balance between military readiness, responsible land management, public access, and regional infrastructure needs,”&amp;nbsp;&lt;b&gt;stated Congressman Paul Gosar.&lt;/b&gt;&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Background:&lt;/b&gt;&lt;/p&gt;
&lt;p&gt;The legislation would establish a permanent withdrawal for lands necessary to safely conduct military testing, training, and advanced air delivery operations while preserving existing public land management responsibilities and utility access. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;Specifically, H.R. 8686&amp;nbsp;authorizes the withdrawal of approximately 21,783 acres adjacent to Highway 95 to create a larger safety buffer zone for military air delivery system testing. According to Army analysis, the additional land is necessary to allow higher-altitude testing, longer glide distances for guided parachute systems, and more complex tactical training scenarios that cannot safely occur under current land limitations. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;The bill also formally withdraws and reserves approximately 249 acres within the Howard Cantonment area that has been continuously used by the Army since 1955 under authorities that have since expired. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;Importantly, the proposal&amp;nbsp;&lt;a data-cke-saved-href="https://public-inspection.federalregister.gov/2024-04383.pdf" href="https://public-inspection.federalregister.gov/2024-04383.pdf"&gt;originated during the Biden Administration&lt;/a&gt;&amp;nbsp;and received environmental review and approval across multiple agencies before ultimately being formally approved under the Trump Administration, underscoring the nonpartisan nature of the military’s operational need.&lt;/p&gt;
&lt;p&gt;Under the legislation, the Department of the Interior would continue managing the withdrawn lands pursuant to the Federal Land Policy and Management Act while allowing for ongoing conservation activities, protection of wildlife habitat, preservation of cultural resources, wildfire management, recreation, hunting access, and management of wild horses and burros. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;Additionally, the legislation preserves the Parker-Blaisdell Utility Corridor and authorizes continued rights-of-way for critical regional utility infrastructure, including transmission lines, ensuring the proposal does not interfere with regional energy reliability or future utility needs. &amp;nbsp;&lt;/p&gt;
&lt;p&gt;The bill amends the&amp;nbsp;&lt;a data-cke-saved-href="https://www.govinfo.gov/content/pkg/PLAW-113publ66/html/PLAW-113publ66.htm" href="https://www.govinfo.gov/content/pkg/PLAW-113publ66/html/PLAW-113publ66.htm"&gt;Military Land Withdrawals Act of 2013&lt;/a&gt;&amp;nbsp;by adding a new subtitle pertaining specifically to the Yuma Proving Ground withdrawal area. &amp;nbsp;&lt;/p&gt;

&lt;p&gt;This bill also rips the curtain back on decades of buried abuse. It creates a public, searchable database naming those who settled or were found liable, including how much they paid and why—while fully protecting victims. And it exposes every taxpayer-funded payout going back to 1995, finally revealing the true scale of this congressional slush fund.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Just as importantly, it ensures that potential crimes can’t be swept under the rug. Any allegation of criminal conduct must be sent straight to the Department of Justice—no NDAs, no internal deals, no delays. Washington, D.C. doesn’t get to police itself in secret anymore.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;And for those who try to game the system, the penalties are severe—at least double damages and ethics investigations, enforced by the Attorney General.&lt;/p&gt;

&lt;p&gt;As President Donald Trump prepares to deliver his upcoming State of the Union address, the contrast in American politics could not be more clear. On one side stands an administration focused on restoring sovereignty, strengthening enforcement, and rebuilding public trust. On the other stands a Democratic Party that has repeatedly chosen obstruction over security — particularly when it comes to the border and election integrity.&lt;/p&gt;
&lt;p&gt;In recent weeks, that divide has come into sharp focus.&lt;/p&gt;
&lt;p&gt;After the House passed a bipartisan, full-year funding bill, Democrats blocked funding for the Department of Homeland Security at the eleventh hour, triggering a partial shutdown. The consequences were immediate: TSA agents, Coast Guard members, Secret Service personnel, and FEMA responders forced to work without pay; cybersecurity operations slowed; counterterrorism readiness strained.&lt;/p&gt;
&lt;p&gt;This was not an unavoidable impasse. It was a deliberate political maneuver.&lt;/p&gt;
&lt;p&gt;For border states like Arizona, the implications are deeply concerning. Our communities have lived with the consequences of federal inaction — fentanyl pouring across the border, cartel activity expanding, local law enforcement stretched thin, ranchers and families bearing the brunt of chaos. When DHS operations are disrupted, even temporarily, Arizona feels it first.&lt;/p&gt;
&lt;p&gt;Yet rather than strengthen enforcement, many Democrats appear intent on weakening it. Shutting down Homeland Security to gain leverage over immigration policy sends a dangerous message: that political positioning matters more than border security. For families who have lost loved ones to drug trafficking or crime tied to illegal immigration, that message rings hollow.&lt;/p&gt;
&lt;p&gt;The same troubling pattern is evident in the debate over election integrity.&lt;/p&gt;
&lt;p&gt;The SAVE America Act, recently passed by House Republicans, affirms a simple principle: voting is a right of U.S. citizenship. It requires proof of citizenship to register and a government-issued photo ID to vote — safeguards that mirror the requirements Americans meet every day to board a plane, buy alcohol, or conduct routine transactions.&lt;/p&gt;
&lt;p&gt;These are hardly radical proposals. They are basic measures designed to restore confidence in elections.&lt;/p&gt;
&lt;p&gt;Yet Democrats overwhelmingly oppose them.&lt;/p&gt;
&lt;p&gt;After years of unprecedented illegal immigration and documented weaknesses in voter registration systems, public trust demands stronger verification — not looser standards. For a border state like Arizona, where migration pressures and administrative strain intersect, maintaining accurate voter rolls is not theoretical. It is essential to ensuring lawful citizens alone determine electoral outcomes.&lt;/p&gt;
&lt;p&gt;As President Trump takes the podium for his State of the Union, he will outline an agenda centered on secure borders, economic renewal, and institutional accountability. He will speak of enforcement restored, inflation curbed, energy unleashed, and American strength reasserted at home and abroad.&lt;/p&gt;
&lt;p&gt;Across the aisle will sit lawmakers who recently forced a shutdown of the agency responsible for homeland security and who continue to resist basic election safeguards.&lt;/p&gt;

&lt;p&gt;According to the response, the Surprise site is under consideration to serve as a 500-1,500 bed processing facility used for intake and short-term transfer of illegals placed into removal proceedings.&amp;nbsp; The average length of stay would generally be three to seven days before transfer to a larger detention center.&amp;nbsp; DHS further indicated that ICE anticipates onboarding such facilities by the end of Fiscal Year 2026, subject to the procurement process and available funding.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Secretary Noem’s response outlined that the facility would adhere to ICE National Detention Standards, include a fully staffed on-site medical unit, reimburse local partners for emergency services, and maintain robust security staffing to ensure the safety of detainees, personnel, and surrounding communities.&amp;nbsp; DHS is also committed to continued engagement with state and local stakeholders and congressional oversight as the project advances.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;However, DHS made clear that the Democrats’ current government shutdown is directly impacting its ability to provide specific timelines for development and operational commencement.&lt;/p&gt;

&lt;p&gt;Nearly a century ago, Supreme Court Justice Louis Brandeis warned that when a government fails to uphold the law, it “breeds contempt for law” and “invites anarchy.” His words remain relevant today.&amp;nbsp; When federal immigration law is ignored, unfunded, or obstructed for political gain, the result is disorder at our border and danger in our communities.&amp;nbsp; The American people deserve a federal government that enforces the law consistently and without apology.&lt;/p&gt;

&lt;p&gt;And Congress never authorized a word&amp;nbsp;of&amp;nbsp;it.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;Optional Practical Training&amp;nbsp;was designed to allow foreign students with F-1 visas to remain in the United States after completing their studies. But instead of a short transition period, the program has ballooned into a sprawling, de facto guest-worker system allowing foreign nationals—many of whom studied here for only a single year—to stay and work in STEM fields for up to three years. It now serves as a shadow substitute for the&amp;nbsp;&lt;a href="https://www.dailysignal.com/2025/11/19/h-1b-visas-are-pushing-americans-out-of-job-market-experts-warn/" target="_blank"&gt;H-1B visa program&lt;/a&gt;, circumventing the very caps Congress put in place to protect American workers.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Advocates claim OPT fills workforce gaps.&amp;nbsp;In reality, it&amp;nbsp;helps create them. Employers are heavily incentivized to hire OPT workers because those workers are exempt from FICA and&amp;nbsp;&lt;a href="https://www.dailysignal.com/tag/medicare" target="_blank"&gt;Medicare&lt;/a&gt;&amp;nbsp;payroll taxes, generating a government-subsidized discount for Big Tech and Big Pharma.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;According to independent analyses, this loophole costs the Social Security and Medicare trust funds&amp;nbsp;roughly&amp;nbsp;$4 billion&amp;nbsp;every year. Meanwhile, American STEM graduates—who worked hard, paid taxes, and played by the rules—are pushed to the back of the hiring line.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The numbers tell the story. In 2024 alone, ICE authorized work permits for&amp;nbsp;nearly 200,000&amp;nbsp;OPT participants, a 21% jump from the previous year, with tens of thousands more through the STEM extension.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The beneficiaries overwhelmingly come from countries like&amp;nbsp;&lt;a href="https://www.ice.gov/doclib/sevis/btn/25_0605_2024-sevis-btn.pdf" target="_blank"&gt;China and India&lt;/a&gt;—nations whose strategic interests do not always align with our own. And the federal government lacks even basic visibility into how many foreign graduates are&amp;nbsp;actually working&amp;nbsp;in sensitive American industries at any given moment. ICE itself has admitted its recordkeeping is inadequate.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;This&amp;nbsp;isn’t&amp;nbsp;just an economic issue—it’s&amp;nbsp;a national security one. A 2022 Government Accountability Office report warned that ICE has not evaluated OPT’s vulnerability to espionage or foreign interference. Yet the Department of Homeland Security continues expanding the list of OPT-eligible STEM fields to include&amp;nbsp;&lt;a href="https://www.dailysignal.com/2025/07/16/threat-multiplier-experts-warn-of-downside-of-artificial-intelligence/" target="_blank"&gt;artificial intelligence&lt;/a&gt;, telecommunications, semiconductor engineering, nuclear engineering, missile systems, reproductive biology, and critical infrastructure management—sectors our adversaries are actively targeting.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Why would we invite foreign students from strategic competitors to work inside America’s most sensitive research, technology, and defense sectors—often without meaningful oversight? Why would we&amp;nbsp;maintain&amp;nbsp;an unregulated guest-worker pipeline that Congress never approved? And why would we subsidize it with taxpayer dollars?&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The answer is simple:&amp;nbsp;We&amp;nbsp;shouldn’t.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Small businesses in&amp;nbsp;my great state of Arizona and&amp;nbsp;all across&amp;nbsp;the country—the backbone of the American economy—are the ones most harmed by this dysfunctional system. They cannot compete with multibillion-dollar corporations that reap tax advantages for hiring cheaper foreign labor.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Meanwhile, American graduates, especially in STEM fields, face an uphill battle securing good-paying jobs in industries their own tax dollars helped build.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The solution is equally simple:&amp;nbsp;terminate&amp;nbsp;OPT. Because the program was created unilaterally by the executive branch, it can&amp;nbsp;be ended&amp;nbsp;with the stroke of a pen. But to ensure it stays gone—and to prevent future administrations from resurrecting similar schemes—Congress must act.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The Fairness for High-Skilled Americans Act&amp;nbsp;permanently ends the OPT program and prohibits any future administration from recreating it without explicit authorization from Congress. It restores congressional authority over immigration policy, protects American workers, strengthens national security, and closes a tax loophole that drains billions from Social Security and Medicare.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;&lt;b&gt;“&lt;/b&gt;Last week’s tragic shooting of two National Guard members in Washington, D.C. within a few feet of the White House on Thanksgiving eve by Afghan national&amp;nbsp;Rahmanullah Lakanwal is a sad reminder of Joe Biden’s reckless and unchecked open-border policies.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Our immigration system is overwhelmed and unmanageable thanks in large part to the previous administration’s open border policies, poorly vetted asylum claims, and visa overstays.&amp;nbsp;We cannot maintain a lawful immigration process when we cannot control our borders or account for who is entering our country.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Fraudulent asylum claims, illicit trafficking, and insufficient vetting present real threats to our national security, our economy, and our citizens. Adversaries are exploiting these failures. Americans are being murdered. Meanwhile, schools, hospitals, law enforcement, and local governments—especially in border states like Arizona—are stretched to their limits.&lt;/p&gt;
